Picking this up late while systems are down.

Disagreeing with some previous comments - Candy Crush actually suggests manager is wrong as it clearly references data "that has not been derived from the records". Suggesting if it was Judge is happy it can be a DP braech.

This is common sense. Ultimately I suggest it depends on the facts in each case.E.g.

1. Nurse walking through ward sees celebrity X having an enema. Tweets about it. Breach of confidence but no DP breach -not derived from hospital records.

2. Nurse walking through ward sees celebrity X alcohol readings, Tweets about it. Breach of confidence and DP breach.

3. Nurse remembers something she read in records of celebrity X 10 years ago. Hospital no longer has any records. Nurse Tweets about it. Breach of confidence but no DP breach.

Somewhere between 2 and 3 an undefinable line is crossed.
