My understanding is that the only thing that has legal status is the entry in the Schedule which is only text. When MPP scheduled they provided a detailed text description of the boundary for this reason. It could be argued, therefore that ‘Ilchester Roman town’ (which I don’t think has been re-done) covers everything in the buried town but you’d have a hard job prosecuting in the areas outside the drawn boundary…

Hi guys

 

Hopefully someone from HE can answer this one, but not sure who I should ask it off.

 

I have a memory that advice used to be that the GIS provided outlines of Scheduled Monuments were NOT the legal boundaries, but an indication of where they were, and that if it came down to it, the boundaries would need to be determined on the ground. Can anyone confirm if this is still the case, or do the NHLE and NMR Download boundaries have legal status?

 

Only asking so I know for giving advice (ie how certain someone can be they’re not going to go into a Scheduled area)
