Hi Janet,

I would suggest disclosing the information that you feel the Police are entitled to request under S.29 and withhold the other information and ask the Police to explain to you how the exclusion of the "date of birth and reasons for leaving" of the other members of staff would prejudice the prosecution of the offender or any other matter mentioned in subsection 1.

If they feel this information is truly pertinent, then they can ask for that information from the data subject, when they interview them and take their statements.

Kind regards

Subject: [data-protection] Request from the police for staff personal details

Hello all

The charity I work for has received a request from the police for personal contact details and dates of birth of several employees (some have since left us), and their reasons for leaving the organisation. The police want to take statements from them relating to fraud which was committed against us a few years ago (the perpetrator is in custody awaiting trial).

Under section 29 of the DPA I feel reasonably comfortable sharing contact details, but the additional information (dates of birth and reasons for leaving) seems unnecessary? Any advice would be appreciated, I'm quite new to data protection and we're not used to dealing with these sorts of requests from the police...

Thank you in advance

Janet
