Dear All,
I am having an interesting conversation with a couple of other IG professionals. The issue has emerged with the following scenario.

Joe blogs puts in a SAR. On day 20 he contacts the council to say “I want to withdraw my consent for this processing”. Is the SAR being processed with consent?

If it is, would any processing associated with that request need to stop and as storing is processing, would that mean associated emails would need to be destroyed? (A separate question is whether the record of the request would need to be retained to demonstrate compliance with the GDRP)

If the SAR is not being processed with consent, then what is the basis for the processing? Is it a contract? Or what condition would justify the processing of the SAR?

Finally, would the applicant receive the response even if they withdrew consent? That is, as the SAR is a statutory process, once started it only stops on completion?

Best,

Lawrence
