My understanding is that the rest of 11/15 has been replaced but the conditions are still lingering. Personally, I wish that they would go, taking the access condition with them. 

Ken’s suggestion of putting some models/examples together based on current practice – with reasoning, sounds like a sound short-term measure.

This was something I raised at England Exec some time ago – that ALGAO should look to produce a/some model condition(s) for use/modification by members.

 

The suggestion met with a positive response but a difficulty in identifying someone to carry it forward.

 

Worth raising with Quinton/Exec again to see if it might be progressed – even though the shifting sands are recognised as a bit of a contextual problem?  Or there is the AGM next month……

Hi All, 

 

There was a brief presentation about this at the ALGAO Training Day last year (I think), in which the use of HE's model condition in GPA was discussed. I raised a query and was met with a barrage of different views - I have since done some casual investigation into the different conditions used across authorities and it varies enormously. 

 

On a side note - our Planning Enforcement team did some training internally some time ago now about improving conditions to make them more enforceable; we changed archaeology conditions accordingly to include, among other things, time constraints on things like WSI submission and notice in advance of fieldwork commencing. However, a subsequent regime change here has moved away from that, and we are now encouraged to use the Planning Inspectorate model conditions. 

 

I have raised concerns about those here - on a number of issues - but mainly about the process of discharging conditions, at what stage, use of part-discharge etc etc. Again, a lot of variation across the country I think. 

 

It strikes me as the kind of thing someone at some stage must have reviewed, varying practices across LPA's?

No easy answer I’m afraid, especially as the neighbourhood planning bill going through HP is looking to constrain the use of pre-commencement conditions.

Currently, the Historic England GP2 has an ‘example’ condition (CLG no longer approves of the term ‘model’) which is I think is useful.  Otherwise, the conditions on the planning inspectorate website and  the old circular 11/95 are I believe still active including the awful access condition.

Is there a final list anywhere of model archaeological planning conditions?

 

I can find documents from EH and ALGAO suggesting wording in response to a consultation about them in 2010, but not the final version of the Conditions. Were they ever produced?
