All,
I have an information sharing agreement to check that sets out specific information sharing arrangements. It has a few “it can only be used for these purposes” and “must not disclose it to
anyone else without their permission” etc but then the information sharing protocol (overarching arrangement) states that as soon as the data enters our IT system “ we become the data controller”.
Therefore does it mean that the restrictions of “it can only be used for these purposes” and “must not disclose it to anyone else without their permission” etc are null and void if we are now
the DC and can disclose to third parties (In compliance with the principles of the DPA of course) without their providing parties permission?
