In terms of a DPA complaint I think you would struggle to overcome s32. But I'm sure your comms people could contact the paper and ask them to remove (they might not comply though, if the officer is senior/public facing).

I am not really up to speed with the Journalism exemption of the DPA, so would be grateful to hear from anyone who is.

 

The Council wrote to a resident asking them to take down a flag. This has become a story on a national newspapers website as the resident has taken it to said newspaper. They have published the letter from the Council in full, including the officers’ title, initial and surname. (Mr A Daze, for example).

 

Are they ok to do this? While the story is a bit silly, I don’t think there is any public interest in publishing the name and by definition their place of work – we don’t have an issue with the rest of the letter. It wouldn’t take much to get the full name. Already UKIP etc are making noises about the story and the officer is feeling a bit intimidated by all this.

 

Do we have a leg to stand on?
