Rather than concentrating solely on the DP issue your authority might be better off doing some damage limitation.  Eg issuing a statement explaining why the regulations have been applied; explaining why it was the right thing to do to apply them;  (assuming that to be the case); emphasising previous attempts to resolve the situation; and pointing out that the individual has not been fined (yet).  Not that any of the publications involved are likely to publish your authority’s version but the statement can go on your website at least.  And perhaps a senior officer can publicly own the decision rather than “Mr A Daze” taking all the flack.
