The recent public release of emails stolen by a hacker from the Democratic
National Committee ("DNC"), and the subsequent lawsuit by disenfranchised
members of the Democratic Party provide a rare insight into the legal
consequences of keeping backups, and in particular backups on removable
media such as backup tapes or optical disks.
