Would he not be a disciplinary if deemed fit by OH and 4 RTW dates missed? He has been given lots of opportunity to RTW.******************************** Please remove this footer before replying.
This is in my opinion now an HR and management issue, if deemed fit and not RTW, OH advice has been given on 4 occasions, I would discharge from OH and advise HR & management this is for them to deal with. I imagine they would use their disciplinary and/or functional capacity processes to terminate contract of employment.

I agree Helen its HR that are asking but appraently in IE (the resident country) they are very tentative in managuing such cases especially if there is a potential RTW date. Unfortunatley there have been 4 RTW dates which never actually transpire.
They are in India currently
