The ACS do not provide the usual RightsLink facility on their open access article pages. Therefore we are unsure whether we require permission to re-use the figure, and if we do, how we go about obtaining it. I've emailed their copyright support and their specific open access support, both came back with the same response - email the open access program director. Unfortunately, she has not responded to any of my attempts to contact her as yet... I wondered whether you'd be able to offer any advice?
