I am rather puzzled by these news reports. The draft Regulation says quite clearly at Recital 23aa that it does not apply to data about dead people - “This Regulation should not apply to data of deceased persons. Member states may provide for rules regarding the processing of data of dead persons” This wording (in the version dated 15 Dec 2015) is slightly different from earlier versions but data about dead people has been excluded from the scope of the draft Regulation for many months.
