The Government has launched a consultation on 28 October on the revised transitional arrangements for the repeal of section 52 of the Copyright, Designs and Patents Act 1988 (“CDPA”).
This new consultation follows the July 2015 revocation of the Government's
previous transitional provisions.
As set out in the consultation, the Government now proposes that the repeal should take effect on 28 April 2016. In addition the Government
is seeking views on its proposal to introduce a date by which lawfully-made copies may no longer be distributed or communicated to the public without permission from the rights holder; this includes advertising and selling the works.
The consultation also asks for views on proposed legislative changes to the CDPA which provides for copyright protection for works made before 1957 and removing compulsory licensing of works where copyright
is revived.
The consultation closes on 9 December 2015 at 16:30 GMT.
During the consultation period, the Government plans to hold meetings, grouped by sectors, in London to discuss the issues raised in the consultation. If you are interested in attending a meeting relevant to
