Afternoon,
We have received some video footage from an external third party organisation as part of a complaint of intimidation from one of our staff to their staff.
Our officer has been disciplined (footage was used in the disciplinary process) and has seen the video footage.
Our officer now wants a copy of the footage. The external third party organisation has demanded we do not supply the footage in question.
My view is that the key question is, “is the Council now the Data Controller of the footage?”. I believe we are and as such need to deal with this as an SAR (taking note of third party personal
data etc).
Would anyone like to confirm I am correct in my thinking about being a DC?
