Subject: Care Act: LAs, student loans and care packages
Hi all
A student of ours has asked me if we can let others in the sector know that as part of the new Care Act (April 2015) local authorities can no longer require disabled students to use proportions (or all) of their student loans towards their care packages.
Relevant sections:
statutory guidance is here https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/366104/43380_23902777_Care_Act_Book.pdf
Annex C, para 28, v - disregarded income "(v) Any grants or loans paid for the purposes of education; and"
Annex B, para 33, f - disregarded capital "(f) Any capital which is to be treated as income or student loans;"
Best wishes
