Indeed, using the word ‘breach’ (in the Data Protection context) is premature. What we have here is an incident; only when your two questions are answered will we know if this is a Data Protection breach.

The wider problem is being sure that the material was truly lost and not “lost”. The chain of custody becomes hugely problematic unless every stage is tracked and recorded. Even then, one can only reduce and never eliminate the potential for something to go “wrong” inside a step.

 

The officers involved with the breach investigation have my sympathy. It will not be an easy task.
