Spot on, Derek.
They may own the paper but you cannot release the records without informed consent as the information written within the records about the employee's personal circumstances is private and confidential. Both to NMC and Data Protection Act clearly set out disclosure rules http://www.nmc-uk.org/nurses-and-midwives/advice-by-topic/a/advice/confidentiality/http://ico.org.uk/for_organisations/data_protection/the_guide/principle_1 (see the bit at the bottom of the page "What is meant by Lawful?)

Liz

Hi all

I have been told to release OH notes to the company solicitor.
They inform me that they do not need to gain consent as they own the notes.

I have always worked on the ethic that consent has to be gained from the person involved before this can be allowed.

The persons involved are the firms  data protection officer and solicitor ...
I am struggling with this as pressure is being applied from high.

Any advice welcomed.

Many thanks

Ruth
