Like Mike I'd have thought you were best off just to contact Matt Groening and/or the Simpsons distributor (are they under Warner Brothers or a similar television/movie house?) for permission, as it's most likely the original picture is a still from one of the programmes that has been reused. If they're not the copyright owners, they most likely may know who is.

It shouldn't be difficult to trace the owners of the Simpson's copyright, and it is possible they will give permission for this use.  They ought to make the effort to get permission.  Publishing in a journal, effectively re-publishing commercially without permission, is a clear breach.

Dear All,

One for your collective brains...


Our orthodontics department uses a picture of Homer Simpson's Head X-ray in a handout in to try and put patients at ease.  They say they originally thought it would come under 'fair use' in copyright law to use it in the department.  However they have just written a journal article about their work and want to use this as an illustration of how we have put patients at ease.

We have not been able to identify the original source of the pic, though there are plenty of examples of it on the internet.  Not surprisingly, the journal will not include the pic without a permissions statement.

Do any of you have any advice that may help - before we say a definite "No".
