As many of you may be aware, local authorities will soon be using the Public Sector Network for various ICT and communications functions.

 

At the moment this means (for my Council anyway), that all new and existing employees will have to eventually undergo a Baseline Personnel Security Standard check. Not quite a DBS check but basically HAVING to use a third party (likely to be Disclosure Scotland) to verify their right to work in the UK and to identify any unspent convictions (what we then do when we identify any unspent convictions is uncertain).

 

The DPA part of this question is how do we do this in compliance with the DPA?

 

1)    Is there an exemption or

2)    Do we say to the employee give us permission to process this request to a third party or you cannot use the PSN and therefore you cannot do your job properly and therefore you will lose your job?

Q. Why do I have to verify unspent convictions?

A. If someone tries to join your organisation with the intent of committing crime it is unlikely that they will declare this during the recruitment process.
