One thing at least you could salvage from the situation is to highlight your profile a bit i.e. involve your Archives and Records Management Depts. in managing and disposing of your information, or this is an example of the potential consequences.

As far as I understand once something is thrown into a skip, it belongs to the skip owner. It is illegal to take things from a skip without permission.

The vendor bought it on an internet auction from a man who bought it on another internet auction.  What we don’t know is whether the person who first sold it on stole it or, as Ed points out below, found it in a skip.  And what I’d be interested to know is whether finding it in a skip equates to theft under Scottish law.  It’s probably all academic anyway as the vendor lives abroad.

Challenging doesn't equate to an accusation of theft or malpractice against the current owner.  There is always the right to challenge, albeit it may end up an unsuccessful challenge because of the reasons Ed suggests. A challenge is worth a try, with appropriate legal advice.


The current owner 'buying the book in good faith' shouldn't affect things. For example if my car was nicked and the police later tracked it down, whoever has ended up owning my car would not be allowed to keep it just because they had bought it from the person who stole it 'in good faith'. I'd want it back, thanks very much.

It may be the town surplused it or just had tossed it in the trash and some one took it home.

Three may be no right to challenge the right of ownership on it. Cities have done stupid things like this before.. toss stuff out and then say..."oh boo hoo! what right does the person that salvaged it have to it!?"

Now.... if some city or town employee stole it... yep get the shackles out! and... we know this sort of thing happens too.

 
Just sayin'.... be real sure before you start lining the lawyers up let you get slapped for doing it.
