The purpose of my early responses to you were not intended to agree or disagree with you about whether the action of Colombia is a particularly egregious example of the phenomenon we were discussing.  For professional reasons, I cannot go into that question here.  Rather, they were designed (1) to answer a factual question you put about other comparable cases, and (2) to suggest that not all claims of non-executability should be taken at face value.  That’s all I wanted to say.

Dear Professor Mendelson:

 

As written in my note, last September 2nd, Nicaragua offcially proposed to Colombia to establish a joint Commission to implement the ICJ Decision. 

 

 

I consider it is a good first sign of political will, using the mechanisms of consultations allowed by international law., to enforce jointly an ICJ decision

 

The response of Colombia about "no applicability" of ICJ decision seems to me

going in the opposite direction.
