If police won't act there's possibility pf a civil remedy for harassment under s3 of Protection from Harassment Act 1997.

Not sure this is rally a council issue though - seems to have moved over into the private realm.

The police are clearly missing the point that Councillor B is being stalked to be filmed!

Subject: Filming

Hi All

Second one today:

Councillor A is acting on behalf of a member of the public (Mrs A) who is continually being filmed by a neighbour (Mrs B). Mrs A has been caused substantial distress by this. This has led to Mrs B continually filming Councillor A. Mrs B attended Councillor A's surgery and started to film him and he asked that she stop filming. Mrs B carried on. Anyway, Mrs B is now following him - even when he walks his dog Mrs B is filming.

I pointed him to the following advice from ICO re. CCTV as I thought the same applied to filming:

http://www.ico.org.uk/for_the_public/topic_specific_guides/cctv

Councillor A has contacted the Police as it is potentially stalking. However, the Police said there is no law against filming. However, I am of the view that this is a Police matter either one of harassment/breach of the peace/stalking.

Have any of you any thoughts on this,

Thanks,

Doreen
