Hi Brenda,

If you hold the information, you are processing it. Ask why are you holding the information and for what purpose? If you can decide that it is your data, then I would imagine you have a requirement to release especially as the child is under 12.

Other information to consider:

Are you sure the parent is not 'estranged'? Are both parents still the legal guardians? Etc. etc.(There's has to be a reason for the request and it's not usually a 'nice' one in my experience).

Subject: [data-protection] School records

A parent made a request to a school for the attendance record of his child before the summer holidays commenced. The school didn't respond within the 15 school days - in fact hasn't responded at all. The school has now closed for the summer holidays. As the local authority we also hold this child's attendance record. The parent is complaining and asking us to supply a copy. Can we ? Should we ? Should we contact the Head Teacher during the break ?
