At present, each local authority within Scotland holds and processes information in relation to the current Children’s Hearings System, local Children’s Panels and the Children’s Panel Advisory Committees. This information is to remain either the responsibility of the local authority or Scottish Government. From 24 June 2013, information relating to the new Children’s Hearings System, the Area Support Teams and national Children’s Panel will be the responsibility of Children’s Hearings Scotland (CHS). CHS will be producing one Records Management Plan to evidence the arrangements in place to manage this information throughout Scotland. In terms of the Data Protection Act 1998, local authorities will be Data Processors for this information and CHS will be Data Controllers. I would be grateful if you could forward this information onto the Records Manager or person responsible for producing your local authority’s Records Management Plan under the Public Records (Scotland) Act 2011 so that they are aware of this transfer in responsibilities from 24 June 2013.
