Dear Georgie, the employee has to apply to whoever is the “data controller” for those health records (e.g. counselling manager?) and request a copy under the Data Protection Act; either parts of or whole record- they need to specify. It is called a “subject access data request”. Attached is a useful guide from the ICO.

Subject: Requesting copy of counseling notes

 

Dear List,

A member of staff has requested a copy of counselling notes from our department.

The question is :

does the employee complete OH consent form to obtain her counselling notes which was left behind by counsellor who left and left the notes there OR is there a specific process for releasing counselling notes. The notes are not part of OH notes.
