Dear All,

The case involves Durham County Council, but I was not involved in the process as it started before I arrived.  I would say that my view would have been very similar, redact.  The judgement is interesting and has been subject to numerous articles, which are worth reading. 

 

What is particularly striking is the near seismic shift in social care records from practically no disclosure to a greater liberalisation of disclosure to relevant parties without litigation and within litigation.  A topic which could have its own discussion.


I would be interested to know how others are dealing with access to care records that may (or may not) contain reference to potential litigation.  Are you advising social care staff of how to identify these types of request or are you relying upon a litigation approach where the request is already directed to legal services?

 

Would be happy to discuss the ways to handle these administratively within the bureaucratic process as that is something I will be involved with. :)
