Hi Doreen,

Yes, domestic purposes applies, however I would say the school has a duty to protect under the Children's Act 1989 which would then put it at odds with parents filming the show.

I would advise the school to offer support to the children and their families that need protecting but you cannot ban video quoting DP as it simply does not apply to individuals filming their kids.

I know this doesn't sit well with school management as they need an excuse to ban as child protection always gets the higher priority and it also goes against the principles of inclusion but it is what it is

Neil

Subject: [data-protection] Peronal Use Videos

Hi folks

That time of year again! I have an issue where a Headteacher has sent a letter out to parents stating that they are not being permitted to take videos of their children taking part in musicals etc. I know ICO's advice stated that that is now OK as it is for personal use. However, the Headteacher does not have permission for two pupils and that is the concern - apparently there are Child Protection issues. My view is that it is for personal use and it should be OK. Two parents have complained as they are only allowed 2 tickets per family and they wouod like to video the show to show the grandparents.

Again your views greatly appreciated.

Thanks,

Doreen
