A “journalist” (is a radio DJ a journalist?) makes a prank call from Australia to UK and blags info from a UK hospital. Does the “journalist” commit the “crime” in UK or Australia (or both)? Is he subject to UK or Australian law?

I'm having a blank moment. Where does the special purposes exemption to s55 appear in DPA ?

On another tack if it is a deliberate prank, can a journalist reasonably believe it is in the public interest ?

In relation to Donald's point, one of the difficulties with a CMP is that , though sensitive PD was potentially exposed, this was already fully in the public domain, so would probably not cross the ICO's guideline threshold. Undertaking at best.

And finally, in the NHS would they have even been able to find a nurse ?  :-)
