Unfortunately this is pretty common. Big company has OH. Subcontracts smaller company who doesn't. Many big companies will cover their contractors with their OH Service but others won't and they should sort this out at the start of any contract. It's primarily the big company's responsibility as the risks are theirs. Regarding the employee, you might already have some duty of care as he has told you his problem so you know. You should probably first explain this to the employee and then explain what you can or can't do, a) based on the information he has already given you b) on the basis of what duty of care you might or might not have c) on the basis of your duty of confidentiality, and d) on the basis of what others have or have not formally asked you do to. Then document the discussion for your own back up and leave the ball primarily in the employees court to discuss with his manager. Hopefully his manager will discuss this with your company and somewhere out of it you will have a referral that you can work with. I have been asked to see the people who work at our site on contract. Apparently the firm who employs them does not have an OH and one member of staff has said this is his first role after being diagnosed with cancer. He has multiple joint problems and is presribed morphine. Do you suggest that I do the assessment and if so who do I send the report to? Or does the firm I work for insist that a full assessment is undertaken before he works on thier site. My business is concerned regarding their duty of care.
