However doesn't the longterm.factor also come in? If pre op he had substantially functional adls without reliance on daily painkillers etc to stay functional and surgical recovery only a matter of month then EA unlikely to apply.

My understanding is that conditions should be regarded in the absence of treatment, so you need to consider what he would be/was like before the surgery.  If his mobility was significantly restricted, he is likely to be regarded as covered by a tribunal although hopefully after your planned phased return, other adjustments will be minimal or not required.

Hello All

 

I am looking for some advice on whether the EqA is likely to apply to a chap I saw who had a total knee replacement due to Osteo-arthritis, which he has had for a number of years. His surgery has been successful and his recovery so far has been uneventful and therefore he is aiming to return to work on a phased return the beginning of October. He is not on any medication or receiving any other treatment for it. His knee is slightly swollen and there is some stiffness as expected. He is walking with a stick to give him confidence at present. I would appreciate your comments.
