I also work to build up a case and then refer on to an independent OHP. I had a case go to tribunal last year because the employer dismissed rather than allow them to go through the process of eihr, it is based on the case First West Yorkshire limited v Haigh, I attach the case – again good background knowledge to have particularly for the capability issues.

Thanks Sue. Usually it was because the first OHP was building up the case and the LGPS rules required an Independent OHP decision therefore the case was then referred on. We used to build up the case then our OHP (who had not had any dealings with the employee) was able to undertake the Independent OHP role. This worked very well and the LGPS never made any comments on the process.

Yes thanks Julie, we do always use OHP but in previous local authorities it was 2 OHPs for validation. For financial reasons we are using OHA and OHP as the 2 opinions, just wondered if the rationale for 2 OHPs was based on something I was not aware of.

Morning everyone,
LGPS rules are very clear the decision must be made by an OHP. We used to progress case to final decision then pass on to our OHP when I worked in Local Government. I think the main reason is to reduce numbers of appeals.

My understanding is that it has to be a medic & memory recalls the regs state the level of qualification accepted, including a GP with Dip Occ Med, as opposed to an OP( of course, in my opinion OPs will give a more informed decision)

We are in the process of reviewing our processes and procedures iro the above- is anyone out there working with the LGPS that we can liaise with? At present we are using an OHA for the first opinion, and the second opinion is given by our OHP. When I worked at Hampshire CC we used 2 OHPs. What are others doing?
