Asbestos victims win appeal
The Supreme Court has ruled that insurance liability for mesothelioma was triggered when employees were exposed to asbestos dust and not when the symptoms emerged. The landmark decision ([2012] UKSC 14) means that many of the 2,500 people diagnosed each year with mesothelioma will receive compensation. The union Unite appealed to the Supreme Court after insurance companies were partly successful in an earlier appeal to the Court of Appeal. The companies argued that in some cases the employers’ liability insurance is ‘triggered’ not by the exposure to asbestos but by the development of the disease, which is always decades later.

RIDDOR reporting
From 6 April, employers no longer have to report injuries that keep workers off normal duties for seven or fewer days. Changes to the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR) mean that the reporting threshold extends from three to seven days. Employers will also be given a longer period in which to report, increasing from 10 to 15 days from the time of the incident. According to the HSE, the changes will result in a 30% fall in the number of incidents that must be reported by law – an average of around 30,000 fewer reports a year.

Fatter shiftworkers
New research suggests that short sleep duration and circadian disruption, which is common among shiftworkers, results in a higher risk of metabolic syndrome and diabetes. The findings, published in Science Translational Medicine, reveal that exposure to prolonged sleep restriction with concurrent circadian disruption, decreased the participants’ resting metabolic rate and increased plasma glucose concentrations after a meal, an effect resulting from inadequate pancreatic insulin secretion. The researchers conclude that prolonged sleep restriction with concurrent circadian disruption alters metabolism and could increase the risk of obesity and diabetes.

Drivers’ working time
The Road Transport (Working Time) (Amendment) Regulations 2012 came into force on 6 April, amending the measures to include self-employed drivers. Self-employed drivers were initially excluded from the scope of the Working Time Directive for Mobile Workers (Directive 2002/15/EC under a ‘sunrise’ clause. The Directive was implemented in Great Britain through the Road Transport (Working Time) Regulations 2005, which the 2012 regulations amend.

HR code of conduct
The CIPD has unveiled a revised code of conduct for HR professionals, supported by new complaints and disciplinary procedures. The new code, which comes into force on 1 July, sets out clear and simple requirements for CIPD members under four headings: professional competence and behaviour; ethical standards and integrity; representative of the profession; and stewardship.

Health and safety panel established
The government has created what it describes as a new ‘myth busting’ challenge panel – the Independent Regulatory Challenge Panel – to help curb the worst examples of health and safety misuse. Run by the HSE, the panel will provide quick advice to people claiming they are subject to ‘ridiculous or disproportionate’ health and safety decisions. The DWP says the panel will ‘separate legitimate decisions to protect people from real risks from those not required in health and safety law’, allowing decisions by insurance companies, local authorities and employers among others to be contested.
