Hello ListWhen our OHP sees anyone as part of a pre-employment health check, the OH report is sent to HR and not to management. The potential employee has a consent form explaining why they are being seen etc but on this consent form they do not have the option to see the OH report first. Not only has the employee the right to see the report but the guidelines from the FOM for the writing of OHP's reports clearly stipulates that the OHP should not write anything in a report that will be a surprise for the employee and that they should both consent for the OHP report to go to the manager and have had sight of it before it goes.
This OHP is working well outside his faculty's guidelines in this matter. he should have been able to explain himself to the candidate and justify his belief even if they didn’t agree.
Our OHP, because he is a quick typist, types the report and lets the employee take the copy home. Most give them 2 days to respond after seeing the report, I believe.

Hi Pauline,
At the pre-employment stage the duty is to the employer, and this may be the reason that a copy was not given. However, there would still be a right under the DPA.

I wonder what your views on this little scenario are
person attends interview and is offered the job but is advised regarding the admin and clinical percentage of the role.
Pre-emp health check results in appt with OHP
OHP writes to the proposed manager and advises - unfit for this particular work due to long tem health concerns in relation to abilities and job description.
proposed employee request copy of letter that OHP has written
Is this person entitled to a copy of the report?
I have my own opinion ( but cant find the case law that I have read on this, typical!) but would like to know the groups views
