Brenda,

Parental access to educational records is under The Education (Pupil Information) (England) Regulations 2005 and I believe this applies whist the pupil is in compulsory education. Access to all other records falls under the DPA 1998 and guidance suggests that a child of 12 years of age who is of normal maturity and development, is capable of granting / refusing consent for their parents to access their records.

Many Thanks

[data-protection] Educational records

At what age does a parent lose the right to access their child's educational records ? From the ICO's guidance, at 12 or above a child is expected to be mature enough to make a request in their own right for 'other information'. However, if the child has left school and is an adult can the parents make a request for historical educational data about their child  without that child's permission. I would say 'No', they can't. Any opinions please.
