Nottinghamshire County Council has a policy whereby all employees are offered posts subject to medical clearance (preferred candidates only as per EA2010).

We screen all forms and see anyone as needed. However with very rare exceptions (eg LGV driver with epilepsy on medication where there is an absolute ban from DVLA), our advice is fit or fit with adjustments and leave the decision to employ or not to the managers.

So a combination of both Anna's and Gillians replies would be okay

Dear Wise and Wisdom,

I have been given a question which is-

Can you offer a job subject to a being cleared as medical fit. In other words is that legal?

My view was yes as if a person has some health issue that could be exacerbated or aggravated by the role the would not be fit....

Over to you all for your view. But some evidence to support your answer would be ideal pretty please on a Friday afternoon.
