Dear Hector -- For the United States, while you may not find legislation directly on point, I would note two documents that may be relevant to your inquiry:

(1) 1988 (Dec. 27) "Proclamation 5928 -- Territorial Sea of the United States".  In addition to establishing a 12nm territorial sea, this Presidential Proclamation affirms the right of innocent passage "as reflected in the applicable provisions of the 1982 United Nations Convention on the Law of the Sea."  Citation: 54 Fed. Reg. 777 (January 9, 1989).  This remains U.S. policy.

(2) 1989 "Joint Statement by the United States of America and the [then-] Union of Soviet Socialist Republics" (aka Jackson Hole Agreement) and its accompanying "Uniform Interpretation of Rules of International Law Governing Innocent Passage."  It says, among other things, "Both Governments have agreed to take the necessary steps to conform their internal laws, regulations and practices with this understanding of the rules."
