Agree with other comments and would add :

1 Commercially sesnsitive is not the criterion

2. If they are serious you must ask them what "prejudice" they will suffer

3. Assuming they can identify some with sufficient likelihood to engage s43(2) - not too difficult perhaps - there is still the PIT to get over with the strong PI in openess transparency and accountability, and often the prejudice they identify will cause the PIT to fail, as they will emphasize e.g. reduced competiveness at retender time whereas the PI will strongly be in favour of getting best value, rather than incumbent getting the contract again at a higher cost.

As part of a request the amounts charged by hardware IT support suppliers have been asked for. One of the suppliers has claimed exemption under 43(2) commercially sensitive. Does this sound right?
