Subject: [OCC-HEALTH] Indemnity insurance

Hello Jane (and Pippa)

Back in the mid 1990’s When the course I lead was delivered at the RCN I was told exactly the same as Jane. I was horrified, particularly in view of the number of OHNs who practice as free lance consultants.  Working at the RCN I was able to hot foot it to Chris Cox and highlight the problem. Chris highlighted that the RCN were worried should some free lance nurses practice outside their sphere of competency, from memory I think he referred to those nurses who work in potentially very lucrative roles as Expert Witnesses. We had a lengthy discussion regarding how OHNs practice, that  clinically compared to nurses working in ITU we are low risk. They get cover why not OHNs. The long shot was that the rules were reviewed so that OHN consultants can get cover but that does not extend to anyone they employ just as Pippa writes below.

So in short, you are covered if you work within your competency. If RCN members  want further clarification I would suggest that you write to Chris Cox, Director of Legal Services at the RCN, 20 Cavendish Square, London W1.

Hope this helps

Anne

Hi JaneThat's very strange. I checked this some time ago and the RCN advised me that I was covered as a sole proprietor as long as not employing others who are not RCN members. They told me that I should not need to get separate cover and this in fact may lead to dispute in the event of a claim. They specifically said that it covers the additional Occ Health component. In conclusion I was advised that I had sufficient cover via the RCN as long as I work within my own competence in line with NMC Code of Conduct and RCN guidelines.Did the RCN advise you that you were not covered?Pippa Stanford

Subject: [OCC-HEALTH] Insurance/indemnity cover
Hi All

I had a shock on Monday when I was told that the RCN insurance I pay monthly does not actually indemnify me if I was to work as a self employed OHA.  I thought it was.....  Also that sole practitioners require public liability insurance (which I do understand)

Any thoughts on this?

Jane
