Yes, I agree with you but having run this past the ICO previously they were happy that by explaining that the organisation were also making a recording for their records and that person 1 had been told up front this was going to be done it was an implied consent. There is also the question around 'is it for domestic purposes?' especially when the person is taking a union member with them and it is likely this will be used by them. This sort of area is nearly as grey as my hair :O)

Caution needs to be exercised here, the individual making a recording of the meeting for his own personal use is covered under the domestic exemption, however, an organisation making a recording against the consent of the individual for business purposes does not have that same route.

Where I previously worked we came up against this time and again and we had a policy of not allowing private meetings/hearings to be recorded unless all parties agreed. This brought about a deadlock so we decided that as the other party was recording the meeting then we would do so as well and retain the recording. As they are one and the same there would be no real problems for either party.
