We had this issue (i forgot to mention in my earlier post), as the DP Officer I informed the company that the data (no matter where the information came from all belongs to the council as we contracted them to carry out the service that includes all the data collected for that purpose(s) - the whole dataset was returned to us and we then handed the appropriate information over to our new contractor, highlighting the terms of information & records management responsibilities etc etc.

Hi - thanks for your replies - further info:

The Council contracted out to provide a service to Young Carers who were referred to them - most referrals come from the Council but not all of them.  The contract has no provision as to who is DC but any referrals from the Council then the data would be ours but not from third parties.

However, Lee - having looked at Schedule 2(6) I think that is the line we may take - thank you for that.

Any further contracts will of course stipulate that the information should be released on the termination of a contract.
