I get a lot of these, just tell them to go back and get a Court Order
for the release, that usually makes them back off as they have to spend
money. Otherwise send out copies that are so redacted as to make them
worthless.

Morning All

 

I am in receipt of a request, from a solicitor, asking for copies of

witness statements (other than his client's) the Council holds.  The

witness statements were obtained in preparation of a potential

prosecution relating to the solicitors client.  The Council did not

pursue the case.

 

The solicitor, wants copies of all the witness statements previously

given to compare them to those he has in his possession to check for any

inconsistencies.

 

Witness statements are the personal information and exempt from

disclosure (S40) aren't they?!
