Yes, she is getting paid.  She isn’t wanting to talk to the business and so it has been really hard for them to communicate with her about the referral.  But I agree that this should have occurred first (it is even on the referral form!).

The manager should have discussed the referral with her in the first place, in an ideal world she would have given consent,  you havent seen her yet. If she wants a copy of any documentation her employer will have a policy to cover disclosure of "stuff" under DPA etc. Not an OH issue

I have been asked to see a lady who has been off with “work related stress” for a long time (prior to mat leave, had mat leave and then got re-signed off by her GP when her mat leave ran out!).  The company is saying that she hasn’t told them why she is still off sick as the person she had the conflict with has now left.  She is requesting to see a copy of the referral (which whilst not personal, contains the company’s perspective which would be unpalatable) prior to the consultation.

 

My initial thoughts are to tell her to obtain a copy from her manager, as at this point she does not yet have an OH medical record and therefore it would be an employment matter.  Any thoughts/advice would be great from such a learned body of people.
