The CNET scenario should not happen here of course! The Draft Code covering scanners says that images are destroyed. Also, if staff did retain images of celebrities “passing through” it should be an offence under S.55 of the DPA. The problem is that I am not sure that the Dept of Transport thinks the DPA applies. They say they have consulted the ICO but do not use the term “personal data” in its draft Code.

The reason why I think the image is personal data is that when the person goes through the scanner, the Airport has other indentifying formation in its possession even though the images are only held for a few seconds it takes for the passenger to go through the security system. However, I admit there are counter arguments

For defects in the Code see http://amberhawk.typepad.com/amberhawk/2010/07/bodyscanner-code-of-practice-still-defective.html.

I am not surprised at all. What I am waiting for is the disclosure a celebrity's body image. It is only a matter of time. Put technology and human nature together and it is unavoidable.

The illusion is that if you can monitor it, measure it, or count it you can control it.

Fact or fiction? You be the judge. CNET is generally a reliable source.
