Site Waste Management Plans (SWMP's)

As has been stated previously SWMP are not new…only that in 2008 they became a legal requirement for sites over £300k.  However, the SWMP regulations were not clear on who was to police them, hence the current confusion.  This has left some developers with option of taking a chance and ignoring it, others do it as a form filling exercise and do the bare minimum.  The recession has not helped either as SWMP are perceived by some as a needless cost.  Only on the large sites has it been fully embraced as there are significant cost savings to be had and improvement in the BREEAM rating of the houses on completion. 

 

One thing that I have noticed is that SWMP tend to be put in place during the construction phase, with the demolition & groundworks stage being omitted (the SWMP reg state that it should be in place throughout the entire project).  Interestingly enough, the sites since 2008 that have always requested a SWMP are those that are being conducted on behalf of Local Authorities or other public bodies. 

 

We are currently managing a large development of over 750 units where it has been included as part of the Compulsory Informative Section of the Planning Approval.  It would seem to be logical to include it as a condition of planning on all sites above the threshold as it can then be dealt with in a similar matter as contamination whereby both the LPA and Agency combine forces. It would then be possible to ensure that they are of sufficient quality.  However, when has logic had anything to do with regulations.

My understanding is SWMPs must be produced for projects >£300k, but are not necessarily submitted to any regulatory authority. I'm not sure if this meets the legal stance/guidance but the impression I get is that the SWMP simply needs to be filed onsite should the EA or LA decide to turn up and inspect it.  However I suspect there are some sites that have not prepared one. 

 

As a WMO and a CLO I would be happy to review SWMPs. Particularly if it can help to keep me in my job.   :-S

From memory, the guidance is non statutory but it advises a 'several year' educational period before enforcement action applies.  As the guidance was introduced in April 2008, I am looking (in these hard times) at whether there is a case for near future CLO/EHO involvement in enforcement. 

 

There appear to be a number of cross over areas.  My initial thoughts are that increased CLO involvement in this area might be very useful.

I thought the whole point is that it is not regulated. It is a voluntary scheme endorsed by the Environment Agency so that they do not need to regulate.
