Dear Tracey Has this employee been officially managerially referred to you for an opinion? Have you got medical evidence to support the alleged diagnosis? If not, and you have a management referral, obtain medical evidence via a disclosure mandate from her/ask her primary medical practitioner questions regarding her alleged diagnosis/explain the effect of the alleged condition on her work/her work on the alleged condition; for example: why her clonic tonic seizures are uncontrolled/is she compliant with medication; raft of issues there/does she have Neurologist consultation/intervention; how receent was that and can you have a copy of the report/what are the issues/is there a co-morbidity which is not disclosed/is she, in his/her opinion fit for the job for which she was employed/and so on. You are then in a better position to advise management with appropriate adjustments if required; I am of the opinion that you must have medical evidence before you can make decisions in this case because it appears that you do not have adequate information to make decisions without it especially when there appears to be a malingering element possibility/maybe other underlying condition(s) – in other words, you don’t really know what’s going on.
