Dim ond y "camau" oedd y "disposals" - reprimand, final warning, ASBO, curfew, dirwy etc’ 

At y "restorative" roedd y "gwneud iawn" yn cyfeirio.

Ar wefan y yjb o dan "Aims and principles of restorative justice" mae'r paragraff cyntaf yn sôn am gyd-drafod a chytuno rhwng y troseddwr a'r dioddefwr:

Restorative justice provides opportunities for those directly affected by an offence – victim, offender and members of the community – to communicate and agree how to deal with the offence and its consequences.

Ond wedyn, mae'n sôn am yr amcanion:

  • victim satisfaction – reducing the fear of the victim and ensuring they feel ‘paid back’ for the harm that has been done to them
  • engagement with the young person – to ensure that they are aware of the consequences of their actions, have the opportunity to make reparation and agree a plan for their restoration in the community
  • creation of community capital – increasing public confidence in the criminal justice system.
Mae hyn yn cynnwys - '...paid back...', '...make reparation...', a '...restoration in the community...' - sef gwahanol agweddau ar "adfer".  Mae'r troseddwyr ifanc yn talu nôl i'r dioddefwr ac yn cael ei adfer i'r gymuned.

Mae "Camau Adfer Pobl Ifanc" yn swnio lot mwy naturiol - ond dyw e ddim yn cynnwys y "Gorchmynion".

Mae 'gwneud iawn' yn cyfleu 'restorative' i fi - ond mae'n aml yn anodd ei ddefnyddio'n dwt. Dw i'n meddwl bod 'camau' yn aml yn ddigon i gyfleu 'disposal' er bod elfen o 'gwblhau' yn rhan o'r syniad - sef 'ffordd o ddelio â rhywbeth' fel y dywed Siân.  Fydda i'n aml yn hepgor y 'disposal' ac yn rhoi 'gorchmynion gwneud iawn' am 'restorative orders'. Un peth arall sy'n broblem fawr yn y maes hwn yw'r 'youth'. I fi, mae 'ieuenctid' yn enw haniaethol sy'n disgrifio'r cyflwr/cyfnod o fod yn ifanc, ond erbyn hyn, mae'n cael ei ddefnyddio'n gyffredinol i gyfieithu 'youth' gan golygu 'pobl ifanc'. Mae'n handi iawn ei ddefnyddio felly a dw i wedi ildio erbyn hyn ond mae rhywbeth yn rhyfedd yn ei gylch hefyd.

Ai "gwaredu" yw ystyr "disposal" fan hyn?  Yn ôl http://www.yjb.gov.uk/en-gb/practitioners/CourtsAndOrders/Disposals/ - mae "disposals" yn golygu'r gwahanol gamau y gellir eu cymryd i ddelio â rhywun sydd wedi troseddu - e.e. reprimand, final warning, ASBO, curfew, dirwy etc

 

Dw i ddim yn siwr am "adferol" - na "restorative" chwaith o ran hynny!

"Gorchmynion ?? ieuenctid trwy gyd-drafod"  neu rywbeth ?
