Interesting conundrem - not convinced that this is strictly an OH issue but maybe colleagues in the police can help.
Obviously working within the criminal justice system some of our staff are expected to attend various legal proceedings. I have a pregnant psychologist who has been told that she is expected to give evidence at a trial a few weeks after her EDD. The trial is the Crown V the individual therefore a criminal proceeding, our employee is expected to give evidence re parole reports that she had done with regards to the accused while he was incarcerated
Her question - if it wasnt for her work she wouldnt be expected to attend, she will be on maternity leave, however they are criminal proceedings . She has been told the police will be contacting her fortnightly and that she is compelled to attend court (or risk being in contempt) when she will be only a few weeks post partum, she wants to know where she stands if (for any reason) she feels tyhat she cant attend or comply with what is needed. Apparently her views are not being considered on this (as well they may not if its a high profile case) . I have advised her to contact her professional organisation, try the police again and also a solicitor as I am minded to think that this is not an employement issue as such - any views?
