The question needs to be addressed is the fit-note guidance or gospel? The resounding answer is guidance. The employee [and some managers] may think it is gospel but it is not. Tough love it is when this pushes managers to make a decision about work-shy people. It is doing the job it is intended! The business can choose the advice it listens to and act upon so don't be disheartened if they don't choose yours this time.
