If the phone
rings and you pick it up and put it down before anyone says anything, how do
you know it was a marketing call. In fact how do you know who it was at all ?

The whole thing is farcical anyway, of course. There is no
"evidence" in or from the phone call.
"He tried to sell to me"
"No I didn't"
The spirit of the law is being ignored here by the UKIC if their
interpretation is correct, and that cannot be right.

In response to your question, yes this call would fall outside of the
Privacy and Electronic Communications Regulations 2003, because as explained
previously, no actual marketing was transmitted before the call was terminated
What if you trapped the caller by saying: "Yes, I'd like to buy, how much
is it", and when they respond with a price, they are nicked!
