Interesting.  Do we not have a duty to inform them what their rights are by informing them of the
contents of the policy?  I always have.

I agree with them! Tie the employee up in process or make it look as if the process meets the needs
and maybe the employee will never know to "ask" for the eye test! And ultimately such a false
economy.

As far as I know they can make the employee follow what ever processes they want prior to the
eyetest such as vision screening etc before hand as long as it is laid down in their policy before
ultimately agreeing to the eyetest. They can though argue that process was not followed and refuse
payment if the employee bypasses the process. A lot of business see OH vision screening as "cost
effective" for some reason .. where they got that idea I have no clue. might be worth outlining the
cost so they can compare it against the cost of employee self-referral to a optician

Seems to me this in breach of Reg 5, I am going mad? Employee are not obliged to have an eye test
under the DSE regs, but the employer is obliged to pay for eye test if the employee does want one.
The eye and eyesight test must be carried out by someone with an opthamic qualification, the
employer can offer as an 'extra' vision screening - a basis eye screen carried out by a nurse with a
basic understanding of the eye.

Our company are telling their employee they will not be refunded if they do not have the vision
screen first, is this legal?
